Intellectual Property Policy

Mr.Deyers Note:

You are responsible for the content you post as a user of Deyers. You may want to contact an attorney if you have concerns about copyright law or trademark law, such as questions about whether your content or your use of another person's name or brand infringes or otherwise violates the rights of another person. If you are unsure if the material you intend to submit to us infringes or otherwise violates the rights of another person, before submitting such content to us, you might also want to seek legal advice first. If you send a notice of a report or violation to us, we can contact you if we have additional questions regarding your notification or report. Please notice that Deyers is not in a position to resolve third-party disputes and may not be in a position to delete the material or suspend the account that you have registered. As an option, to try to fix your problem directly, you might want to contact the person who posted the content or owns the account.

Copyright Policy


Copyright is a civil privilege that preserves authorship of original works (e.g. videos, music, artwork, etc.). Copyright usually covers an original representation of an idea (e.g. how a video, music, or artwork is expressed or produced in a particular way) but does not protect the underlying ideas or evidence.

Breach of Copyright
WE DO NOT allow any copyright-infringing content. The use without proper permission or legally valid purpose of copyrighted material of others which lead to a violation of Deyers' policies. Not all unauthorized uses of copyrighted content at the same time constitute an infringement. In such cases, exceptions to copyright infringement, such as the fair use doctrine or other applicable statutes, permit the use of copyrighted material.

Content Removal; Account suspension or termination
Any user material that violates the copyright of another person should be deleted. The account may be suspended or terminated in connection with the use of the Deyers platform or app or other violations of the Terms of Service and Group Guidelines for numerous copyright violations. We reserve the right to deny the opening of a new account on Deyers' web or app, or otherwise hosted by Deyers, to any account holder whose account was used for inappropriate activities.

Notification of Copyright Infringement
Your issue will be answered more easily and in a way that is more helpful to you, the consumer, and our community by contacting the user directly. You can also file a Complaint of Copyright Infringement.
The details requested in our online Copyright Infringement Report form should contain all complaints. Failure to provide the details needed can restrict our ability to investigate your claims and can result in the denial of your complaint. We can provide your contact information to the account holder, including the email address and the copyright owner's name, and/or complaint details. Please be aware before submitting a notice that knowingly submitting a misleading or fraudulent report may result in liability for damages under section 512(f) of the Digital Millennium Copyright Act of the United States (DMCA) or similar laws as may be applicable in other countries.

Counter-Notification Copyright Infringement
If you receive a notice of copyright infringement that you believe to be in error or believe that you are allowed to use the content, you may directly contact the copyright owner to request a withdrawal. Via our Counter Notification Form, you can also provide us with a counter-notification. The details requested should be included in the Counter Notification Form for all counter-notifications. Failure to provide the details needed can restrict our ability to investigate your claims and can lead to the denial of your counter-notification.
It will take time to complete the counter-notification process. Please be patient. At this time, under the United States Digital Millennium Copyright Act (DMCA) or similar laws in other countries, the copyright claimant may file an action seeking a court order to hold the content down. Please note that, in compliance with our Terms of Services and Privacy Policy, we will forward the entire counter-notification to the original reporter, including any contact details you have. To file a lawsuit against you, the complainant will use this details.

Trademarks

A trademark is a term, emblem, logo, design or combination of all of the above that defines and distinguishes the source of a product or service from other goods or services.

Breach of Trademark
Trademark laws forbid misuse of a trademark that is generally an unauthorized use of a trademark or service mark in connection with products or services in a manner that is likely to cause confusion, fraud or error as to the source, origin, sponsorship or association of the goods and/or services involved.

At the same time, the use of another mark for the purpose of correctly referencing, legitimately commenting, criticizing, parodying or evaluating the goods or services of the proprietor of the mark or for the purpose of comparing them with other goods or services, where the mark is not used for the purpose of designating the user's own goods or services or that of a third party, is not usually considered to be an infringement of that mark or service. Similarly, even without the brand's permission, it is usually legal to build a fan page about a brand, if you do not claim to speak for or be affiliated with the brand or otherwise breach the intellectual property rights of the brand.

Repeated infringements of trademark rights in connection with the use of the Deyers website or app or other infringements of the Terms of Service and the Community Guidelines which lead to the suspension or termination of the user account. We reserve the right to deny the opening of a new account on Deyers' web or app, or otherwise hosted by Deyers, to any account holder whose account was used for inappropriate activities.

Complaint against Trademark and Notice

A Trademark Infringement Report can also be submitted by you. The details requested in our online Trademark Infringement Report form should appear in all complaints. Failure to provide the details needed can restrict our ability to deal with your claims and can result in the denial of your complaint. In compliance with our Terms of Services and Privacy Policy, we can provide the account holder with your contact information, including the email address and name of the trademark holders, and/or details of the complaint. Please be informed, before submitting a notice, that knowingly submitting a false or fraudulent report can lead to liability under the laws for damages, as may be applicable in some countries.

Counter-Notification Patent Infringement
If you receive a notice of a trademark infringement that you believe to be in error or believe that you are allowed to use the content, you may directly contact the trademark owner to request a withdrawal. You can also make a counter-notification available to us through our online Counter Notification Form. The details requested on our online Counter Notification Form should be included in all counter notifications. Failure to provide the details needed can restrict our ability to investigate your claims and can lead to the denial of your counter-notification.

Final Note:

The intellectual property rights of others are respected by Deyers, and we expect you to do the same. The Deyers Terms of Service and Community Guidelines do not allow any content that violates or abuses the copyrights, trademarks or other intellectual property rights of someone else to be uploaded, shared or sent.
